Founding Supporter Terms

These Founding Supporter Terms ("these Terms") apply to lifetime Founding Supporter purchases made on feltune.com. They are in addition to our Terms of Use and Privacy Policy. Where they conflict for a Founding Supporter purchase, these Terms control.

These purchases are made through our website and processed by Paddle as Merchant of Record — not through Apple In-App Purchase. If you have questions, contact support@feltune.com.

1) What you are buying

• A one-time payment that grants lifetime access to the Plus tier on your feltune account, available immediately upon activation.
• This is a commercial purchase of a digital product. You are buying access to a working service available now.
• You are not purchasing ownership of any music or content; all streaming use remains governed by our Terms of Use.
• This purchase does not grant any equity, profit share, voting rights, dividends, financial return, or ownership interest in Feltune. It is not an investment and is not a security under any applicable law.

2) What "lifetime" means

• "Lifetime" means access to Plus features for as long as feltune continues to operate the Service. It is not a guarantee that the Service will operate indefinitely.
• The entitlement is tied to a single feltune account, is bound to the email used at purchase, and is non-transferable and non-resellable.

3) iOS only (iPhone & iPad)

feltune is currently available only on iOS (iPhone and iPad). There is no Android or web player. Your lifetime entitlement can only be used within the feltune iOS app. Please do not purchase if you do not have access to an iPhone or iPad.

4) Service availability and evolution

• feltune is a live service available for immediate use upon purchase activation. Features, catalog, and user interface will continue to evolve over time as part of normal product development.
• feltune does not use AI-generated music; the catalog consists of human-made recordings curated and added on an ongoing basis.
• You acknowledge that as a Founding Supporter of an evolving consumer service, the specific features, catalog composition, and user experience may change. Your lifetime access entitles you to the Plus tier as it exists from time to time, not to any specific feature, song, or interface element.

5) Activation & redemption

• Your lifetime entitlement is delivered to the email address you use at checkout.
• To activate it, sign in to the feltune iOS app using that same email address. Your Plus access will apply automatically once your account is verified.
• If you used a different email at checkout than in the app, contact support@feltune.com with your Paddle order receipt and we will reassign it.

6) Refunds

• You may request a full refund within 14 days of purchase, provided you have not yet activated (redeemed) the lifetime entitlement in the app.
• Once the entitlement has been activated, the purchase is non-refundable.
• Refunds are processed by Paddle. To request one, contact support@feltune.com with your order receipt.

7) Changes to the Service

We may modify, suspend, or discontinue the Service or any feature at any time. If the Service is discontinued, lifetime entitlements end and no refund or compensation is owed.

8) Your statutory rights

Nothing in these Terms limits or excludes any rights you have under mandatory consumer-protection laws of your country of residence that cannot be waived by agreement.

9) Payment & Merchant of Record

• Payments are sold and processed by Paddle.com as the Merchant of Record. Your purchase is subject to Paddle's buyer terms in addition to these Terms.
• Prices are charged in US Dollars. Paddle calculates and remits any applicable sales tax / VAT / GST.
• Early-bird pricing, where offered, is limited in quantity and available on a first-come basis until the stated limit is reached.

10) Limitation of liability

• To the maximum extent permitted by law, Feltune's total aggregate liability arising out of or relating to your Founding Supporter purchase shall not exceed the amount you paid for the lifetime entitlement.
• In no event shall Feltune be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or service interruption.
• Nothing in this section limits liability that cannot be limited under applicable law (including, where applicable, liability for fraud, gross negligence, or breach of mandatory consumer-protection rights).

11) Dispute resolution & class action waiver

• Any dispute arising out of or relating to these Terms or your Founding Supporter purchase that cannot be resolved through good-faith communication with us at support@feltune.com within 60 days shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association (AAA) in Cheyenne, Wyoming, in English.
• You and Feltune each waive the right to participate in any class, collective, or representative proceeding. Disputes must be brought in your individual capacity only.
• Notwithstanding the above, either party may bring an action in small-claims court for qualifying disputes, or seek injunctive relief in a court of competent jurisdiction to protect intellectual property.
• This clause does not apply where mandatory consumer-protection laws of your country of residence prohibit pre-dispute arbitration or class action waivers.

12) Risk acknowledgement

You acknowledge that feltune is an early-stage independent music platform, that the music streaming industry is subject to regulatory and commercial uncertainty, and that no representations or warranties are made about future profitability, growth, or continuity of Feltune beyond those expressly set out in these Terms.

13) Severability & entire agreement

• If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force.
• These Terms, together with the Terms of Use and Privacy Policy, constitute the entire agreement between you and Feltune regarding your Founding Supporter purchase, and supersede any prior communications.

14) Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles, except where mandatory consumer-protection law of your country of residence applies.
